Notice of Public Meeting to Receive Public Comment Regarding

Proposed Planning and Development Lease

The New Mexico State Land Office (“SLO”) will hold a public meeting at the Doña Ana County Building, 845 N Motel Blvd., Las Cruces, NM 88007, on May 12, 2025, starting at 6:00 p.m. MST, to take public comment regarding a proposed planning and development lease of 460.341 acres of state trust lands (hereinafter, the “Land”) in the East Mesa of Las Cruces. The Land is located near Organ Mountain High School within the corporate limits of the city of Las Cruces being part of the SW¼ of Section 23 and all of the W½ of Section 26 Twp. 22 South, Rge. 2 East, N.M.P.M. The Land will be leased, if at all, for a 20-year term pursuant to the terms of a planning and development lease, for the sole purpose of a planning and development project, which will include formulation of a Master Plan or Planned Unit Development (PUD) which must be approved by the Commissioner and any other governmental entities whose approval is required.  The planning and development project will be performed with respect to the Land and an adjacent 322.188-acre tract of state trust lands to the West (being the E½ of Section 27, Twp. 22 South, Rge. 2 East, N.M.P.M.) leased to a master developer in 2018. The new lease will require that the project designate at least 40% of development units in the Master Plan or PUD area are for Affordable Housing.

The lease will include provisions for an improvement value credit to the lessee for increased value to trust land as a result of the lessee’s placement of infrastructure and/or procurement of government approvals.  The credit will be granted upon subsequent lease, sale, or exchange of the Land, as provided in the lease and in applicable State Land Office rules. 

If the SLO makes a final decision to proceed with issuance of a lease, the Commissioner of Public Lands would conduct a lease auction in accordance with the New Mexico Enabling Act, state statutes and State Land Office rules.
