Permission to Survey
Provide a notice of intent to conduct a survey of the proposed location. No ground disturbance other than staking is allowed with the survey.
Right of Way Application
Right of Way: means a right or privilege granted by the commissioner, to pass over, upon, through, or across, a defined area of trust lands for a prescribed purpose and time, which right can be terminated as provided in this part (NMAC 126.96.36.199 D). The application must include the following:
- Non-refundable $250.00 fee
- Survey plat by a registered surveyor
- Quarter/Quarter breakdown (aliquot parts): number of rods and acres in each 40 acre tract
- Cover letter to include office and field contact person(s)
- Surface damage and performance bond
The easement rent is based on the price schedule.
Right of Entry
A Right of Entry types include temporary use for access roads, remediation, and fast-lines. The access permit is valid for up to 180 days at a time. Renewals and extensions for up to an additional 180 days may be approved. A permit can be issued for 1 day up to 180 days but must be stated in the original request and cannot be changed once the permit has been approved by the State Land Commissioner. In all cases, a legal description of the area must be submitted with the request form. The standard rate is $530.00.
